What is a Crime?
In criminal law, a crime (or offence) is not just a wrong committed against an individual—it is treated as an offence against the entire State.
Because of this, the State steps in to protect its citizens. Once a crime happens:
- Law Enforcement (like the Police or the Bribery Commission) steps in to investigate and bring the matter to court.
- The investigating authority becomes the “Complainant.”
- The actual victim (the person against whom or in respect of whom the offence is alleged to have been committed) becomes a “Witness.”
- The person who is alleged to have committed the offence is called a “Suspect” during the investigation, and an “Accused” once the formal case begins.
Criminal Law vs. Civil Law
These two branches of law fundamentally differ in the manner of enforcing the law.
- Criminal Law aims to protect society and punish wrongdoers through measures like imprisonment, fines, confiscation, and compensation.
- Civil Law aims to fix private disputes or civil wrongs through restitution, compensation, and declaring legal rights.
The Rules and Laws
Criminal law covers a wide range of rules, divided into two main categories:
- Substantive Law (found in the Penal Code and other Acts) defines what an illegal act is and what punishment goes with it.
- Procedural Law (primarily the Code of Criminal Procedure Act No. 15 of 1979) lays down the general rules and steps for how a criminal case must be handled.
Jurisdiction
In Sri Lanka, criminal cases are inquired into or tried by specific courts depending on how serious they are:
- Magistrate’s Courts inquire into or try less serious offences. The prosecution is usually conducted by public authorities like the Police, Bribery Commission, or Excise Department. Trials here proceed on a “Charge Sheet.”
- Provincial High Courts (including Trial-at-Bars) try more serious crimes. Trials are presided over by a single judge (or three judges in a Trial-at-Bar), and the prosecution is handled by the Officers of the Attorney General’s Department or the Bribery Commission (where the allegations relate to bribery or corruptions). Trials here proceed on an “Indictment.”
The Appeal Process
If someone is unsatisfied with a court decision, the law provides following paths for appeal:
- From a Magistrate Court: Appeals from Judgements or final orders go to the Provincial High Court within whose judicial zone the Magistrate’s Court which pronounced the impugned order situates as a matter of right. If a party to the matter is dissatisfied with that High Court decision, it can appeal to the Supreme Court (with leave from the High Court or Special Leave from the Supreme Court first had and obtained).
- From a Provincial High Court: Appeals regarding a conviction, sentence, or order go straight to the Court of Appeal as a matter of right. If a party to the Appeal is dissatisfied with the the Court of Appeal’s judgment, it can appeal to the Supreme Court (with leave from the Court of Appeal or Special Leave from the Supreme Court first had and obtained).
Right to Representation
The Constitution of the Republic of Sri Lanka (Article 13) and the Code of Criminal Procedure Act (CCPA) protect individuals through vital safeguards:
- Article 13(1): No person shall be arrested except according to procedure established by law. Any person arrested shall be informed of the reason for his arrest
- Article 13(3): Any person charged with an offence shall be entitled to be heard, in person or by an attorney-at-law, at a fair trial by a competent court
- Article 13(4): No person shall be punished with death or imprisonment except by order of a competent court, made in accordance with procedure established by law
- Article 13(5): Every person shall be presumed innocent until he is proved guilty
- Section 260 of CCPA: Any Aggrieved party (a person against whom or in respect of whom offence is alleged to have been committed) shall have right to be represented in Court by an Attorney-at-Law.
The Standard of Proof
- Beyond Reasonable Doubt: In a criminal case, the standard of proof is extremely high. The prosecution carries the full burden to prove the Accused is guilty “beyond reasonable doubt” (subject to, however, a few exceptions where burden on some facts fall on the Accused)
- The Right to Defend & Cross-Examination: Every Accused person has the right to defend themselves through an Attorney-at-Law. The main and most powerful tool an Accused has to challenge the prosecution’s case is Cross-Examination—testing the truth and reliability of the witnesses presented against them.

අපරාධයක් යනු කුමක්ද?
අපරාධ නීතිය යටතේ අපරාධයක් (හෝ වරදක්) යනු හුදෙක් පුද්ගලයකුට එරෙහිව කරන ලද වරදක් පමණක් නොව—එය මුළු රාජ්යයටම එරෙහිව කරන ලද වරදක් ලෙස සලකනු ලැබේ.
මේ නිසා රජය තම පුරවැසියන් ආරක්ෂා කිරීමට මැදිහත් වේ. අපරාධයක් සිදුවූ පසු:
- නීතිය ක්රියාත්මක කරන ආයතන (පොලිසිය හෝ අල්ලස් හෝ දූෂණ චෝදනා විමර්ශන කොමිෂන් සභාව වැනි) විමර්ශන සිදු කර අධිකරණයට කරුණු ඉදිරිපත් කරයි.
- විමර්ශනය පවත්වන ආයතනය “පැමිණිල්ල” (Complainant) බවට පත්වේ.
- සැබෑ වින්දිතයා (වරදට බදුන් වූ පුද්ගලයා) “සාක්ෂිකරුවෙක්” බවට පත්වේ.
- වරදක් සිදු කළ බවට චෝදනා ලබන පුද්ගලයා විමර්ශන අවධියේදී “සැකකරුවෙක්” ලෙසද, විධිමත් නඩු කටයුත්ත ආරම්භ වූ පසු “චෝදනා ලැබූ තැනැත්තා” (Accused) ලෙසද හැඳින්වේ.
අපරාධ නීතිය සහ සිවිල් නීතිය අතර වෙනස
මෙම නීති අංශ දෙක නීතිය ක්රියාත්මක කරන ආකාරය අතින් මූලික වශයෙන් වෙනස් වේ:
- අපරාධ නීතිය සමාජය ආරක්ෂා කිරීම අරමුණු කරගත් අතර, සිරගත කිරීම්, දඩ මුදල්, රාජසන්තක කිරීම් සහ වන්දි ගෙවීම් වැනි දඬුවම් ලබා දීම මගින් වරදකරුවන් දඬුවම් කරයි.
- සිවිල් නීතිය පෞද්ගලික ආරවුල් හෝ සිවිල් වැරදි යථා තත්ත්වයට පත් කිරීම, වන්දි ලබා දීම සහ නීතිමය අයිතිවාසිකම් ප්රකාශ කිරීම මගින් විසඳීමට අරමුණු කරයි.
හරයාත්මක නීතිය හා කාර්යය පටිපාටිමය නීතිය
අපරාධ නීතිය පුළුල් පරාසයක් ආවරණය වන අතර එය ප්රධාන කාණ්ඩ දෙකකට බෙදේ.
- හරයාත්මක නීතිය – (දණ්ඩ නීති සංග්රහය සහ වෙනත් පනත් වල අඩංගු) නීති විරෝධී ක්රියාවක් යනු කුමක්ද සහ ඒ සඳහා නියම වන දඬුවම කුමක්ද යන්න නිර්වචනය කරයි.
- කාර්යය පටිපාටිමය නීතිය – (ප්රධාන වශයෙන් 1979 අංක 15 දරන අපරාධ විධාන සංග්රහ පනත) අපරාධ නඩුවක් පවරා පවත්වාගෙන යා යුතු සාමාන්ය රීති සහ පියවරයන් දක්වයි.
අධිකරණ බලය සහ නඩු පැවරීම
ශ්රී ලංකාවේ අපරාධ නඩු, ඒවායේ බරපතලකම අනුව, නිශ්චිත අධිකරණ විසින් විමර්ශනය හෝ විභාග කරනු ලබයි:
- මහේස්ත්රාත් අධිකරණ – බරපතල නොවූ වැරදි විමර්ශනය හෝ විභාග කරයි. මෙහි නඩු පැවරීම සහ පැමිණිල්ල් මෙහෙයවීම සාමාන්යයෙන් පොලිසිය, අල්ලස් කොමිෂන් සභාව, දෙපාර්තමේන්තු හෝ වෙනත් රජයේ ආයතන විසින් සිදු කරනු ලැබේ. මෙහි නඩු විභාගයන් ඉදිරියට යනු ලබන්නේ “චෝදනා පත්රයක්” (Charge Sheet) මඟිනි.
- පළාත්බද මහාධිකරණ (ත්රිපුද්ගල මහාධිකරණ ඇතුළුව) – වඩාත් බරපතල අපරාධ විභාග කරයි. මෙහි එක් විනිසුරුවරයෙකු (හෝ ත්රිපුද්ගල මහාධිකරණයක විනිසුරුවරුන් තිදෙනෙක්) විසින් නඩු විභාගය පවත්වනු ලබන අතර, නඩු පැවරීම නීතිපති දෙපාර්තමේන්තුව හෝ අල්ලස් කොමිෂන් සභාව (අල්ලස් හෝ දූෂණ චෝදනා සම්බන්ධයෙන් නම්) විසින් සිදු කරනු ලැබේ. මෙහි නඩු විභාගයන් ඉදිරියට යනු ලබන්නේ “අධිචෝදනාපත්රයක්” (Indictment) මඟිනි.
අභියාචන ක්රියාවලිය
අධිකරණ තීන්දුවක් සම්බන්ධයෙන් යමෙක් සෑහීමකට පත් නොවන්නේ නම්, නීතිය මඟින් අභියාචනා ඉදිරිපත් කිරීමට පහත මාර්ග සපයා ඇත:
- මහේස්ත්රාත් අධිකරණයකින්: මහේස්ත්රාත් අධිකරණයක ලබාදෙන තීන්දු හෝ අවසන් නියෝගවලට එරෙහිව, අදාළ මහේස්ත්රාත් අධිකරණය පිහිටා ඇති අධිකරණ කලාපය තුළ ඇති පළාත්බද මහාධිකරණය වෙත අයිතියක් ලෙස අභියාචනා ඉදිරිපත් කළ හැකිය. යම් පාර්ශ්වයක් එම මහාධිකරණ තීන්දුව සම්බන්ධයෙන් සෑහීමකට පත් නොවන්නේ නම්, (අදාළ මහාධිකරණයෙන් ලබා ගන්නා අවසරය මත හෝ ශ්රේෂ්ඨාධිකරණයේ විශේෂ අවසරය මත) ශ්රේෂ්ඨාධිකරණයට අභියාචනා කළ හැකිය.
- පළාත්බද මහාධිකරණයකින්: වරදකරු කිරීම්, දඬුවම් හෝ නියෝග සම්බන්ධයෙන් පළාත් මහාධිකරණයෙන් අභියාචනා අයිතියක් ලෙස අභියාචනාධිකරණය වෙත ඉදිරිපත් කළ හැක. අභියාචනාධිකරණය විසින් ලබාදෙන තීන්දුව සම්බන්ධයෙන් යම් පාර්ශවයක් සෑහීමකට පත් නොවන්නේ නම්, (අභියාචනාධිකරණයෙන් ලබා ගන්නා අවසරය මත හෝ ශ්රේෂ්ඨාධිකරණයේ විශේෂ අවසරය මත) ශ්රේෂ්ඨාධිකරණය වෙත අභියාචනා කළ හැකිය.
නීතිඥ නියෝජනයට ඇති අයිතිවාසිකම්
ශ්රී ලංකා ප්රජාතාන්ත්රික සමාජවාදී ජනරජයේ ආණ්ඩුක්රම ව්යවස්ථාවේ (13 වැනි වගන්තිය) සහ අපරාධ නඩු විධාන සංග්රහ පනත යටතේ පුරවැසියන් ආරක්ෂා කරනු ලබන වැදගත් ප්රතිපාදන සපයා ඇත:
- 13(1) වගන්තිය: නීතියේ පිහිටුවා ඇති ක්රියාමාර්ගයට අනුව මිස කිසිදු පුද්ගලයකු අත්අඩංගුවට නොගත යුතුය. අත්අඩංගුවට ගන්නා ලද ඕනෑම පුද්ගලයකුට අත්අඩංගුවට ගැනීමට හේතුව දැන්විය යුතුය.
- 13(3) වගන්තිය: වරදක් සම්බන්ධයෙන් චෝදනා ලැබූ ඕනෑම පුද්ගලයකුට, නිසි බලය ඇති අධිකරණයක් ඉදිරියේ සාධාරණ නඩු විභාගයකදී, තමන් විසින්ම හෝ නීතිඥවරයෙකු මාර්ගයෙන් පෙනී සිට තම විත්තිවාචකය ඉදිරිපත් කිරීමට අයිතියක් ඇත.
- 13(4) වගන්තිය: නීතියේ දක්වා ඇති ක්රියාමාර්ගයට අනුකූලව, නිසි බලය ඇති අධිකරණයක් විසින් ලබා දෙන නියෝගයකින් හැර කිසිදු පුද්ගලයකුට මරණ දණ්ඩනය හෝ සිර දඬුවම් ලබා නොදිය යුතුය.
- 13(5) වගන්තිය: වරදකරුවකු බවට ඔප්පු කරන තෙක් සෑම පුද්ගලයකුටම නිර්දෝෂීභාවයේ පූර්ව නිගමනය සදහා අයිතියක් ඇත.
- අපරාධ නඩු විධාන සංග්රහ පනතේ 260 වගන්තිය: ඕනෑම අගතියට පත් පාර්ශවයකට (වරදට බදුන් වූ පුද්ගලයා) නීතිඥවරයෙකු මඟින් අධිකරණයේ පෙනී සිටීමට අයිතිය ඇත.
අපරාධ නඩුවක ඔප්පු කිරීමේ භාරය
- සාධාරණ සැකයකින් තොරව: අපරාධ නඩුවකදී ඔප්පු කිරීමේ භාරය අතිශයින් ඉහළය. චෝදනා ලබන තැනැත්තා වරදකරු බව “සාධාරණ සැකයකින් තොරව” ඔප්පු කිරීමේ සම්පූර්ණ භාරය පැමිණිල්ල මෙහෙයවන පාර්ශවය වෙත පැවරේ. (කෙසේ වෙතත්, යම් කරුණු සම්බන්ධයෙන් ඔප්පු කිරීමේ භාරය විත්තිකරුට පැවරෙන නීතිමය ව්යතිරේක අවස්ථා ඇත).
- හරස් ප්රශ්න කිරීමේ අයිතිය: සෑම චෝදනා ලබන අයෙකුටම නීතිඥවරයෙකු හරහා තමන් වෙනුවෙන් පෙනී සිටීමට අයිතියක් ඇත. පැමිණිල්ලේ සාක්ෂි අභියෝග කිරීමට විත්තිකරුවෙකුට ඇති ප්රධාන සහ වඩාත්ම බලවත් මෙවලම වන්නේ හරස් ප්රශ්න කිරීමයි—එනම් තමන්ට එරෙහිව ඉදිරිපත් කරන ලද සාක්ෂිකරුවන්ගේ සත්යතාව සහ විශ්වසනීයත්වය පරීක්ෂා කිරීමයි
වියාචනය – ඉහත සපයා ඇති තොරතුරු මහජනතාවට සාමාන්ය නීතිමය දැනුවත්භාවය ලබා දීම සඳහා පමණක් අදහස් කර ඇති අතර, එය කිසිදු විටෙක විධිමත් නීතිමය උපදෙසක් ලෙස හෝ නීතිඥ-සේවාදායක සබඳතාවක් ඇති කිරීමක් ලෙස නොසැලකිය යුතුය. පුද්ගලික තත්ත්වයන් සඳහා සැමවිටම වෘත්තීය නීති උපදෙස් ලබාගන්න.
Family and Matrimonial Law
While family and matrimonial law operates within the framework of an adversarial court system, it fundamentally differs from other legal domains because it directly engages human emotions, broken relationships, and the welfare of children. In this sensitive arena, a lawyer’s duty transcends traditional advocacy; professionals must actively steer clients toward constructive compromise and amicable resolutions rather than exploiting conflict for tactical victories. By prioritizing mediation and de-escalation over protracted litigation, legal practitioners must be committed to safeguard the long-term emotional well-being of families and, most importantly, shield vulnerable children from the collateral damage of a bitter judicial battle.
Legal practitioners in Sri Lanka are frequently called upon to handle several key aspects of family and matrimonial law, which are adjudicated at both the District Court and Magistrate’s Court levels
Divorce
Divorce entails the dissolution of marriage, which follows specific legal consequences such as alimony and the legal and physical custody of children. In Sri Lanka, while irretrievable breakdown is not yet recognized as a ground, a successful applicant must establish one of three matrimonial faults: adultery, malicious desertion, or incurable impotency at the time of marriage. These cases must be filed in the District Court within whose jurisdiction either spouse resides, where the marriage was registered, or where the matrimonial fault occurred.
Custody
Custody of the children is of paramount importance, with the District Court deemed the upper guardian of the minors. Although Roman-Dutch law and traditional Sri Lankan society historically favored the father’s preferable right to custody of children, local courts follow English law which prioritizes the “best interests of the child” above any parental entitlement. Custody is divided into physical custody (where the child resides) and legal custody (who makes major life decisions), with joint custody also being a viable option. If custody is not sought during the initial divorce action, a separate habeas corpus application must be filed in the District Court.
Testamentary Actions
Testamentary actions govern situations where the estate of a deceased family member is administered and distributed among the beneficiaries. If the deceased left a last will, it must be properly probated by the District Court so that their explicit wishes are carried out to the letter, as a valid will always supersedes the legal entitlement of intestate heirs. When no will is left and the estate exceeds the statutory financial threshold of Rs. 4 million, the heirs must institute an action in the District Court to have the estate formally administered and distributed according to the rules of succession. However, even where the estate value is below Rs. 4 million and the estate is encumbered with a lot of complexities or you intend to pledge the property to be devolved with a financial institute to obtain a financial facility, it is advisable to have the estate formally administered and distributed by a proper legal channel.
Adoption
Adoption is a complex legal scenario where genuine intentions and financial capability alone are not enough to secure a placement. Anyone wishing to adopt a child must strictly follow the procedures set out in the Adoption Ordinance No. 24 of 1941 (as amended by Act No. 54 of 1943) by making a formal application to the District Court. Numerous statutory rules must be satisfied, and the entire process remains subject to the rigorous and ongoing scrutiny of the District Court both before and after the adoption order is made.
Maintenance
Child and spousal maintenance is strictly governed by the Maintenance Act No. 37 of 1999. Under this law, spouses, minor children up to age 18, adult offspring up to 25, and disabled offspring regardless of age who cannot maintain themselves are entitled to financial support from financially capable spouses or parents—covering marital, non-marital, and adopted children alike. Maintenance cases are brought before a Magistrate’s Court via a simple affidavit, and the magistrate, after giving the Respondent to show case can order a monthly allowance and enforce compliance by imposing imprisonment on a defaulting Respondent.
Domestic Violence
Domestic violence is actively addressed under the Prevention of Domestic Violence Act No. 34 of 2005. Any person who has suffered, is experiencing, or is likely to face an act of domestic violence as defined by the Act may apply to the Magistrate’s Court for immediate relief. The magistrate can issue an interim protection order initially, followed by a formal inquiry leading to a Protection Order valid for 12 months that restrains the respondent from specific harmful acts, with any violation carrying criminal penalties.
(Note: Additionally, to amend entries in official documents such as marriage or birth certificates, formal orders from the District Court must be sought.)

පවුල් සහ විවාහ නීතිය
පවුල් සහ විවාහ නීතිය එදිරිවාදී අධිකරණ රාමුවක් (adversarial court system) තුළ ක්රියාත්මක වුවද, එය අනෙකුත් නීතිමය ක්ෂේත්රවලින් මූලික වශයෙන් වෙනස් වේ. මන්ද යත්, එය සෘජුවම මානුෂීය හැඟීම්, බිඳී ගිය සබඳතා සහ දරුවන්ගේ සුභසාධනය සමඟ බැඳී පවතින බැවිනි. මෙම සංවේදී ක්ෂේත්රය තුළ නීතිඥවරයෙකුගේ වෘත්තීය වගකීම සාම්ප්රදායික රාමුවෙන් ඔබ්බට යයි; එනම් වෘත්තිකයන් විසින් නඩු ජයග්රහණ සඳහා ගැටුම් තීව්ර කරනවා වෙනුවට, නිර්මාණාත්මක සම්මුතීන් සහ එකඟතා කරා සේවාදායකයන් යොමු කිරීමට උත්සාහ කළ යුතුය. දීර්ඝ නඩු විභාගයකට වඩා අන්යෝන්ය අවබෝධය සහ සමථය මූලික කර ගත් විසදුම් තුළින් අමිහිරි අධිකරණ ක්රියාවලියක අහිතකර ප්රතිවිපාකවලින් අහිංසක දරුවන් ආරක්ෂා කර ගැනීමට නීති වෘත්තිකයන් කැප විය යුතුය.
ශ්රී ලංකාව තුළ දිස්ත්රික් සහ මහේස්ත්රාත් අධිකරණ මට්ටම් දෙකෙහි, පවුල් සහ විවාහ නීතියට අයත් ප්රධාන අංශ කිහිපයක් පහත පරිදි වේ.
දික්කසාදය (Divorce)
දික්කසාදය යනු විවාහය විසුරුවා හැරීම වන අතර, එය ස්ථිර දික්කසාද දීමනා (alimony) සහ දරුවන්ගේ නීතිමය මෙන්ම භෞතික භාරකාරත්වය වැනි විශේෂ නීතිමය ප්රතිවිපාකවලට යටත් වේ. ශ්රී ලංකාව තුළ නැවත පිළිසකර කල නොහැකි සේ විවාහය බිඳවැටීම පදනම් කරගත් පොදු දික්කසාද ක්රමයක් තවමත් පිළිගෙන නොමැති අතර, සාර්ථක පැමිණිකරුවෙකු දික්කසාද තීන්දුවක් ලබා ගැනීම සඳහා විවාහක දෝෂ තුනෙන් එකක් එනම්; අනාචාරය (adultery), ද්වේශසහගත අතහැර යාම (malicious desertion) හෝ විවාහ අවස්ථාවේ පැවති සුව කළ නොහැකි ලිංගික බෙලහීනතාවය (incurable impotency) යන කාරණයක් සනාථ කළ යුතුය. මෙම නඩු දෙපක්ෂයෙන් අයෙකු පදිංචි අධිකරණ බල ප්රදේශයේ, විවාහය ලියාපදිංචි කළ ස්ථානයේ හෝ විවාහ දෝෂය සිදු වූ ස්ථානයේ පිහිටි දිස්ත්රික් අධිකරණයේ ගොනු කළ හැකිය.
භාරකාරත්වය (Custody)
දරුවන්ගේ භාරකාරත්වය ඉතා වැදගත් වන අතර, දිස්ත්රික් අධිකරණය බාලවයස්කරුවන්ගේ උත්තරීතර භාරකරු ලෙස සැලකේ. රෝම-ලන්දේසි නීතියට අනුව සහ සාම්ප්රදායික ශ්රී ලංකා සමාජයේ චින්තනයට අනුව පියාට දරුවෙකුගේ භාරකාරත්වය සඳහා ප්රමුඛ අයිතියක් ඇති බව පිළිගැණුනද, ශ්රී ලංකාවේ අධිකරණ අනුගමනය කරන්නේ ඉංග්රීසි නීතියයි. ඒ අනුව දෙමාපියන්ගේ අයිතිවාසිකම්වලට වඩා “දරුවාගේ උපරිම යහපත” ට (best interests of the child) මුල්තැන දෙයි. භාරකාරත්වය ප්රධාන වශයෙන් වර්ග දෙකකි: භෞතික භාරකාරත්වය (දරුවා සමඟ වාසය කරන පාර්ශවය) සහ නීතිමය භාරකාරත්වය (දරුවන්ගේ ජීවිතයට බලපාන වැදගත් තීරණ ගන්නා පාර්ශ්වය). මීට අමතරව හවුල් භාරකාරත්වය (joint custody) ද අධිකරණය විසින් සළ්කා බැළේ. මූලික දික්කසාද නඩුවේදී භාරකාරත්වය ඉල්ලා නොමැති නම්, දරුවන්ගේ භාරකාරත්වය ඉල්ලා දිස්ත්රික් අධිකරණයේ වෙනම හේබියස් කෝපස් (Habeas Corpus) අයදුම්පතක් ගොනු කළ යුතුය.
බූදල් නඩු (Testamentary Actions)
බූදල් නඩුවක් මඟින් මියගිය පවුලේ සාමාජිකයෙකුගේ දේපළ පරිපාලනය කර ප්රතිලාභීන් අතර බෙදා හැරීම සිදු කෙරේ. මියගිය තැනැත්තා අවසන් කැමැති පත්රයක් සහිතව මිය ගොස් ඇත්නම්, ඔහුගේ/ඇයගේ අවසන් අභිප්රායන් අකුරටම ඉටු කිරීම සඳහා එයට දිස්ත්රික් අධිකරණය මඟින් නිසි ලෙස ප්රොබේට් (probate) නියෝගයක් ලබා ගත යුතුය කළ යුතුය; මන්ද නීත්යානුකූල අවසන් කැමැති පත්රයක් ප්රකාශයක් සෑම විටම අවසන් කැමැති පත්රයක් නොමැති විට දේපල උරුමකම් ලබන උරුමක්කාරයන්ගේ අයිතිවාසිකම් අභිබවා යන බැවිනි. අවසන් කැමැති පත්රයක් නොමැති විට සහ මිය ගිය පුද්ගලයාගේ දේපළ වටිනාකම රුපියල් මිලියන 4 ක ව්යවස්ථාපිත සීමාව ඉක්මවා යන විට, නීත්යානුකූල අනුප්රාප්තික නීතිවලට අනුව දේපළ විධිමත්ව පරිපාලනය කර බෙදා හැරීම සඳහා උරුමක්කාරයන් දිස්ත්රික් අධිකරණයේ නඩුවක් පැවරිය යුතුය. කෙසේ වෙතත්, දේපළෙහි වටිනාකම රුපියල් මිලියන 4 ට අඩු වුවද, එය සංකීර්ණ ස්වභාවයක් ගනී නම් හෝ මූල්ය ආයතනයකින් ණය පහසුකමක් ලබා ගැනීම සඳහා එම දේපළ උකස් කිරීමට අදහස් කරන්නේ නම්, නිසි නීතිමය මාර්ගයක් හරහා දේපළ විධිමත්ව පරිපාලනය කරවා ගැනීම සුදුසුය.
කුල වද්දා ගැනීම (Adoption)
කුල වද්දා ගැනීම (දරුකමට හදා ගැනීම) යනු අවංක අභිප්රායන් සහ මූල්යමය හැකියාව මත පමණක් කළ නොහැකි සංකීර්ණ නීතිමය ක්රියාවලියකි. දරුවෙකු දරුකමට හදා ගැනීමට අපේක්ෂා කරන ඕනෑම අයෙක් 1941 අංක 24 දරන (1943 අංක 54 දරන පනතින් සංශෝධිත) කුල වද්දා ගැනීමේ ආඥාපනතේ දක්වා ඇති ක්රියා පටිපාටි දැඩි ලෙස අනුගමනය කරමින් දිස්ත්රික් අධිකරණය වෙත විධිමත්ව අයදුම්පතක් ඉදිරිපත් කළ යුතුය. ව්යවස්ථාපිත නීති රීති රාශියක් සපුරා තිබිය යුතු අතර, දරුකමට හදා ගැනීමේ නියෝගය ලබා දීමට පෙර සහ පසු සම්පූර්ණ ක්රියාවලියම දිස්ත්රික් අධිකරණයේ දැඩි පරීකෂාවට ලක් වේ.
නඩත්තු (Maintenance)
දරුවන් සහ වෛවාහික නඩත්තු කිරීම පාලනය වන්නේ 1999 අංක 37 දරන නඩත්තු පනත මඟිනි. මෙම පනත යටතේ තමාව නඩත්තු කර ගැනීමට නොහැකි ස්වාමිපුරුෂයා හෝ භාර්යාව, වයස අවුරුදු 18 ට අඩු බාලවයස්කාර දරුවන්, වයස අවුරුදු 25 දක්වා වැඩිහිටි දරුවන් සහ ඕනෑම වයසක පසුවන ආබාධිත දරුවන්, ප්රමාණවත් වත්කම් ඇති කලත්රයෙකුගෙන් හෝ දෙමාපියන්ගෙන් මූල්යමය ආධාර ලැබීමට හිමිකම් ලබයි; මෙයට විවාහක, අවිවාහක හෝ දරුකමට හදාගත් දරුවන් ද ඇතුළත් වේ. සරල දිවුරුම් ප්රකාශයක් මඟින් මහේස්ත්රාත් අධිකරණය වෙත නඩත්තු නඩුවක් ගොනු කළ හැකි අතර, වගඋත්තරකරුට කරුණු දැක්වීමට අවස්ථාව ලබා දීමෙන් පසු, මහේස්ත්රාත්වරයා සෑහීමකට පත්වන්නේ නම් මාසික නඩත්තු දීමනාවක් නියම කිරීමට සහ එමනියෝගය කඩ කරන වගඋත්තරකරුවෙකුට සිර දඬුවම් නියම කිරීම මඟින් එම නියෝගය බලාත්මක කිරීමට බලය ඇත.
ගෘහස්ථ හිංසනය (Domestic Violence)
2005 අංක 34 දරන ගෘහස්ථ හිංසන පනත ක්රියාත්මක වීමත් සමඟ ගෘහස්ථ හිංසනය තවදුරටත් නොසලකා හරින ලද කරුණක් නොවේ. පනතේ අර්ථ දක්වා ඇති ආකාරයට ගෘහස්ථ හිංසන ක්රියාවකට ලක් වූ, ලක් වෙමින් පවතින හෝ ලක් වීමට ඉඩ ඇති තැනැත්තෙකුට ආරක්ෂක නියෝගයක් ලබා ගැනීම සඳහා මහේස්ත්රාත් අධිකරණයට අයදුම් කළ හැකිය. මහේස්ත්රාත්වරයාට මුල් අවස්ථාවේදී අතුරු ආරක්ෂක නියෝගයක් නිකුත් කළ හැකි අතර, විධිමත්ව කරුණු විමර්ශනය කිරීමෙන් පසු, වගඋත්තරකරුට එරෙහිව අයදුම්කරු ආරක්ෂා කිරීම සඳහා පනතේ සඳහන් විවිධ ක්රියාවලින් වළක්වාලමින් මාස 12 ක කාලයක් සඳහා වලංගු වන ආරක්ෂක නියෝගයක් (Protection Order) නිකුත් කළ හැකිය. ආරක්ෂක නියෝගය කඩ කිරීම පනත යටතේ දඬුවම් ලැබිය හැකි වරදකි.

Sri Lanka’s Money Recovery Regime
The legal framework for money recovery in Sri Lanka is highly structured, offering distinct statutory tracks designed to balance the interests of creditors with procedural efficiency. Broadly, the regime is split between offence-based recovery at the Magistrate’s Court level and civil recovery across various levels of the civil court system.
Choosing the correct forum and procedure depends entirely on the nature of the transaction, the type of debtor, the quantum of the claim, and the instruments of debt in hand.
Offence-Based Recovery (Magistrate’s Court Level)
When a default involves Cheques, the law provides offence-based mechanisms prosecuted in the Magistrate’s Court.
- Bills of Exchange Ordinance (As amended by Act No. 13 of 2025)
As per Section 82A it is an offence when a cheque drawn by a customer on an account maintained by him to discharge, in whole or in part, any debt or liability is returned unpaid by the bank due to insufficiency of funds in the account, the cheque amount exceeding the pre-arranged agreement with the bank, the drawer issuing the cheque from a closed account and the drawer countermanding the cheque without a legitimate reason.
such person shall be deemed to have committed an offence and shall, on conviction, be liable to a fine equivalent to the amount of the cheque, or to imprisonment of either description for a term not exceeding two years, or to both such fine and imprisonment.
- Debt Recovery Act (No. 02 of 1990 as amended by Act No. 09 of 1994)
For any persons, Section 25 of the Debt Recovery (Special Provisions) Act, No. 2 of 1990 (as amended by Act No. 9 of 1994) provides a parallel offence-based route. Accordingly, it is a summary offence if a person knowingly draws a cheque which is dishonoured for want of funds, countermands a payment order to a bank with a dishonest intention
Any person guilty of offence shall on conviction by a Magistrate after summary trial be liable to punishment with imprisonment of either description for a term which may extend to one year or with fine of ten thousand rupees or ten per centum of the full value of the cheque, order, authority or inland bill in respect of which the offence is committed, whichever is higher, or with both such fine and imprisonment.
Civil Recovery Avenues (Civil Court Level)
Civil recovery proceedings are aimed at obtaining an enforceable civil decree. Litigants have three primary procedural routes in the Civil Courts: Regular Actions, Liquid Claims, and Special Lending Institution procedures.
- Regular Actions (Civil Procedure Code – CPC)
The standard civil litigation under the Civil Procedure Code is utilized for written, unwritten or contested debts or breach of commercial contracts. Regular Actions commence with a formal plaint with summons issued to the Defendants who may file Answers. Upon the settlement of issues in the matter, parties proceed to the trial at the end of which, the Court pronounce a Judgment.
- Liquid Claims / Summary Procedure (Chapter LIII CPC)
Where a claim is for a debt or a liquidated demand in money arising upon a bill of exchange, promissory note, cheque, written contract, or guarantee, Chapter LIII of the CPC allows creditors to fast-track proceedings. If the Court is satisfied, Decree Nisi is issued at the first instance without the participation of the Defendants. The defendant is strictly barred from appearing or defending the action unless they apply for and obtain “Leave to Appear and Defend”. The leave is conditioned and if leave is refused or not applied for, the plaintiff is entitled to an immediate decree absolute.
- Special Summary Procedure for Lending Institutions (Debt Recovery Act, No. 2 of 1990)
Licensed lending institutions (such as commercial banks and registered finance companies) enjoy a highly expedited and rigorous summary recovery procedure under the Debt Recovery Act.
- Small Claims Courts’ Procedure Act, No. 33 of 2022
To make low-value debt (as of present less than Rs. 2 million) recovery rapid and inexpensive, the Small Claims Courts’ Procedure Act, No. 33 of 2022 established a highly simplified regime. The plaintiff must file supporting affidavits and all documentary evidence at the time of presenting the Plaint. The answer and supporting affidavits/documents must be filed within one month of appearance. If both parties consent, the Judge can pronounce final judgment solely on the basis of written pleadings, affidavits, and documents without any oral trial.
N.B – Courts play a strictly supportive role (such as granting interim protective measures and enforcement) and decline jurisdiction if a valid written Arbitration Agreement exists in the contract. In Sri Lanka, Commercial Arbitration is governed by Arbitration Act No. 11 of 1995

පැහැර හැරීමක් චෙක්පතක් සම්බන්ධයෙන් සිදුවන විට, නීතිය මඟින් මහෙස්ත්රාත් අධිකරණය හමුවේ නඩු පවරනු ලබන වරදක් පදනම් කරගත් ක්රමවේද සපයයි.
- විනිමය බිල්පත් ආඥාපනත (2025 අංක 13 දරන පනතියෙන් සංශෝධිත)
82අ වගන්තියට අනුව, ගනුදෙනුකරුවෙකු විසින් ණය මුදලක් හෝ මූල්යමය වගකීමක් සම්පූර්ණයෙන් හෝ කොටසක් වශයෙන් පියවීම සඳහා තමන් පවත්වාගෙන යනු ලබන ගිණුමකින් නිකුත් කරන ලද චෙක්පතක්, ගිණුමේ ප්රමාණවත් මුදල් නොමැතිකම, බැංකුව සමඟ ඇති පූර්ව එකඟතාව ඉක්මවා යාම, වසා දැමූ ගිණුමකින් චෙක්පත නිකුත් කිරීම හෝ නීත්යානුකූල හේතුවක් නොමැතිව චෙක්පත ගෙවීම නතර කිරීම (countermand) යන හේතූන් මත බැංකුව විසින් අගරු කරන ලද්දේ නම්, එවැනි තැනැත්තෙකු වරදක් කළ අයෙකු ලෙස සැලකිය යුතුය.
එම තැනැත්තා වරදකරු වීමෙන් පසු, චෙක්පතේ මුදලට සමාන දඩයකට හෝ වසර දෙකකට නොවැඩි කාලයක බරපතල හෝ සාමාන්ය සිර දඬුවමකට හෝ එම දඩය සහ සිර දඬුවම් දෙකටම යටත් විය යුතුය.
- ණය ආපසු අය කර ගැනීමේ පනත (1990 අංක 2 දරන සහ 1994 අංක 9 දරන පනතින් සංශෝධිත)
ඕනෑම පුද්ගලයෙකු සඳහා, 1990 අංක 2 දරන ණය අය කර ගැනීමේ (විශේෂ විධිවිධාන) පනතේ 25 වගන්තිය (1994 අංක 9 දරන පනතින් සංශෝධිත) සමාන්තර වරදක් පදනම් කරගත් මාර්ගයක් සපයයි. ඒ අනුව, අරමුදල් ප්රමාණවත් නොවීම නිසා අගරු වන බව දැන දැනම චෙක්පතක් නිකුත් කිරීම හෝ වංක චේතනාවෙන් යුතුව බැංකුවට ලබා දුන් ගෙවීම් අණක් අවලංගු කිරීම ලඝු වැරදකි.
මහෙස්ත්රාත්වරයෙකු විසින් ලඝු නඩු විභාගයකින් පසු වරදකරු කරනු ලබන ඕනෑම පුද්ගලයෙකුට, වසරකට නොවැඩි කාලයක බරපතල හෝ සාමාන්ය සිර දඬුවමකින් හෝ රුපියල් දහසහස් දහයක (රු. 10,000) දඩයකින් හෝ අදාළ චෙක්පතේ, අණෙහි හෝ බිල්පතේ මුළු වටිනාකමින් සියයට දහයක (10%) දඩයකින් (වැඩි අගය තෝරා ගනු ලැබේ) හෝ එම දඩ සහ සිර දඬුවම් දෙකෙන්ම දඬුවම් ලැබිය හැකිය.
සිවිල් අය කර ගැනීමේ මාර්ග (සිවිල් අධිකරණ තලය)
සිවිල් අය කර ගැනීමේ ක්රියාමාර්ගවල අරමුණ වන්නේ බලාත්මක කළ හැකි සිවිල් ආඥාවක් ලබා ගැනීමයි. නඩු පවරන්නන්ට සිවිල් අධිකරණ තුළ මූලික ක්රියා පටිපාටි මාර්ග තුනක් ඇත: එනම් සාමාන්ය නඩු , ලඝු කාර්ය නඩු සහ විශේෂ ණය දෙන ආයතන ක්රියාපටිපාටි වේ.
- සාමාන්ය නඩු (සිවිල් නඩු විධාන සංග්රහය)
සාමාන්ය කාර්යය පටිපාටිය ලිඛිත හෝ අලිඛිත හෝ මතභේදාත්මක ණය හෝ වාණිජ කොන්ත්රාත් උල්ලංඝනය කිරීම් සඳහා භාවිතා වේ. සාමාන්ය කාර්යය පටිපාටිය යටතේ නඩු ආරම්භ විත්තිකරුවන්ට සිතාසි සමග ගොනු කළ පැමිණිල්ලක් මගිනි. ඒ සඳහා විත්තිකරුවන්ට පිළිතුරු ගොනු කළ හැකිය. විසදිය යුතු ප්රශ්න මත නඩු විභාගය පවත්වන අතර, එහි අවසානයේදී අධිකරණය විසින් තීන්දුවක් ප්රකාශයට පත් කරයි.

බලපත්රලාභී ණය දෙන ආයතන සදහා (වාණිජ බැංකු සහ ලියාපදිංචි මූල්ය සමාගම් වැනි) ණය අය කර ගැනීමේ පනත යටතේ ඉතා කඩිනම් සහ ලඝු අය කර ගැනීමේ ක්රියා පටිපාටියක් හදන්වා දී ඇත.
- 2022 අංක 33 දරන සුළු හිමිකම් අධිකරණ ක්රියාපටිපාටි පනත
සුළු ණය හිමි කමක් (වර්තමානයේ රුපියල් මිලියන 2 කට අඩු) අය කර ගැනීමට 2022 අංක 33 දරන සුළු හිමිකම් අධිකරණ ක්රියාපටිපාටිය පනත මඟින් වේගවත් හා අඩු වියදම් සහිත හා ඉතා සරල ක්රියා පටිපාටියක් හදුන්වා දෙන ලදී. පැමිණිල්ල ඉදිරිපත් කරන අවස්ථාවේදීම පැමිණිලිකරු විසින් දිවුරුම් ප්රකාශ සහ සියලුම ලේඛන සාක්ෂි ගොනු කළ යුතුය. පිළිතුර, දිවුරුම් ප්රකාශ සහ විත්තිකරු විශ්වාසය තබන ලේඛන විත්තිකරු අධිකරණයට ඉදිරිපත් වීමෙන් පසු මාසයක් ඇතුළත ගොනු කළ යුතුය. දෙපාර්ශවයේම කැමැත්ත ඇත්තේ නම්, නඩු විභාගයකින් තොරව වුවද හුදෙක් ලිඛිත ලේඛන, දිවුරුම් ප්රකාශ සහ ලේඛන මත පමණක් පදනම්ව විනිසුරුවරයාට අවසාන තීන්දුව ප්රකාශ කළ හැකිය.

Writ Jurisdiction in Sri Lanka
In the legal framework of Sri Lanka, prerogative writs serve as vital judicial mechanisms to challenge, review, and control the legality of actions, decisions, and orders made by administrative authorities, inferior courts, and tribunals.
Constitutional Basis and Concurrent Jurisdiction
- The Court of Appeal: Under Article 140 and Article 141 of the Constitution, Subject to the provisions of the Constitution, the Court of Appeal shall have full power and authority to inspect and examine the records of any Court of First Instance or tribunal or other institution and grant and issue, according to law, orders in the nature of writs of certiorari, prohibition, procedendo, mandamus and quo warranto against the judge of any Court of First Instance or tribunal or other institution or any other person
- Devolution via the 13th Amendment: Following the introduction of the 13th Amendment, Article 154P(4) vested the Provincial High Courts with jurisdiction to issue writs of habeas corpus in respect of illegal detentions within the province, and writs in the nature of certiorari, prohibition, procedendo, mandamus, and quo warranto against any person exercising power under any law or provincial statute in respect of matters set out in the Provincial Council List (List I of the Ninth Schedule).
- Concurrent Jurisdiction: Presently, both the Court of Appeal and the Provincial High Courts exercise concurrent writ jurisdiction regarding matters falling under the provincial domain, providing litigants with localized access for administrative review.
Understanding Prerogative Writs
Orders in the nature of writ takes various forms.
- Certiorari: To quash an illegal administrative decision, order, or ruling made by a public tribunal, statutory board, or state official that violated natural justice or unreasonable or was based on irrelevant considerations.
- Mandamus: To compel a public official or local authority to perform a positive act which they are legally bound to do but have arbitrarily withheld.
- Prohibition: To prevent an inferior tribunal or quasi-judicial body from exceeding its legal jurisdiction or proceeding with a matter outside its powers.
- Quo Warranto: To challenge the legal authority of a person holding a public office or statutory position to determine whether they are legally entitled to occupy it.
- Habeas Corpus: To secure the production and release of a person who is illegally or improperly detained in either public or private custody.

- Judicature Act No. 02 of 1978 (Section 41): Empowers Attorney-at-Law to represent clients in courts, tribunals, and institutions administering justice, but explicitly does not extend to police stations.
- ICCPR Act No. 56 of 2007 (Section 4): Restricts the right to legal representation exclusively to individuals charged with a criminal offence, and only within a court setting.
The Turning Point: Extraordinary Gazette No. 1758/36
Because general laws failed to recognize legal representation at Police Stations, the breakthrough came through Extraordinary Gazette Notification No. 1758/36 published on 18th May, 2012 which promulgated the Police (Appearance of Attorneys-at-Law at Police Stations) Rules, 2012 under Section 55 of the Police Ordinance.
Formulated as a direct legal consequence of the fundamental rights application in D.W.C. Mohotti v. Upul Seneviratne (OIC Bambalapitiya) & Others (SCFR 427/2009), these rules legally mandate that police officers island-wide must treat Attorneys-at-Law representing clients with cordiality and courtesy, grant them a fair and patient hearing, and refrain from any physical force, abusive language, or intimidation. Furthermore, the rules govern the proper procedure for Attorneys-at-Law surrendering suspects, establish a four-member Special Committee to monitor compliance, and subject violating officers to disciplinary inquiries and punishment under the Police Ordinance.

හැරවුම් ලක්ෂ්යය: 1758/36 දරන අති විශේෂ ගැසට් පත්රය
පොලිස් ස්ථානවලදී නීතිමය නියෝජනය පිළිගැනීමට සාමාන්ය නීති අසමත් වූ නිසා, පෙරළියක් ඇති වූයේ 1865 අංක 16 දරන පොලිස් ආඥාපනතේ 55 වන වගන්තිය යටතේ 2012 මැයි 18 වන දින ප්රකාශයට පත් කරන ලද, 2012 පොලිස් (පොලිස් ස්ථානවලදී නීතිඥවරුන් පෙනී සිටීම) රීති ප්රකාශයට පත් කළ 1758/36 දරන අති විශේෂ ගැසට් නිවේදනය හරහාය.

Appellate Advocacy: Legal Framework & Appeal Routes
What is Appellate Advocacy?
The judicial system functions at two primary levels:
- Original or Trial Courts: The forum where evidence is formally introduced and evaluated, witnesses are examined, and the trial judge pronounces an initial judgment.
- Appellate or Reviewing Courts: Courts that review lower court judgments. As a general rule, no fresh evidence is taken (subject to rare, exceptional circumstances).
Scope of Review
Appellate courts examine whether the trial judge:
- Committed a material error of law.
- Misevaluated the evidence.
- Failed to address core issues framed at trial.
- Was misled or misguided on facts or law to the prejudice of the appealing party.
Deference to Trial Judges: While appellate courts will intervene in cases of material error, they do not lightly disturb factual findings. Greater deference is given to the discretion exercised by the trial judge, who has the “priceless benefit of viewing the demeanor and deportment of the witnesses,” whereas appellate courts are guided primarily by written briefs and records.
Character of Appeals and Review
Legal remedies against lower court decisions take several distinct forms:
- Appeal as of Right: An absolute right available to any dissatisfied party against judgments or final orders of lower courts.
- Appeal with Leave (First Had and Obtained from Lower Court): There is no automatic right to appeal. The party must first secure leave from the court that pronounced the judgment, based on a substantial question of law.
- Appeal on Special Leave (from Higher Court): There is no right of appeal. The party must first secure special leave or permission directly from the higher court to which it seeks to appeal, based on a substantial question of law.
- Revision: An extraordinary, discretionary jurisdiction of the appellate court. There is no right to revision. It is exercised only if there is an illegality, impropriety, or procedural error in the lower court’s judgment or order that shocks the conscience of the court. As a general rule, appeals as of right are restricted to judgments or final orders, whereas revision can be invoked for judgments, final orders, as well as interlocutory/interim orders.

A. Criminal Courts

Prevention of Frauds
The Prevention of Frauds Ordinance No. 7 of 1840 is the principal statute governing the formalities for transactions affecting immovable property in Sri Lanka. It requires specified transactions, including sales, purchases, transfers, assignments and mortgages of land, and agreements intended to create interests or encumbrances over immovable property, to comply with prescribed formalities before they can have legal effect. Certain leases, including leases at will or for a period not exceeding one month, are excluded from these requirements.
The Ordinance generally requires the relevant deed or instrument to be in writing, duly signed by the executants and attested by a licensed Notary Public in the presence of the required witnesses. It also provides for the affixing of the prescribed thumb, finger or toe impressions of the executants to the relevant instruments. Similar safeguards apply to the execution of wills and codicils.
The Ordinance has been strengthened by the Prevention of Frauds (Amendment) Act, No. 30 of 2022 and the Prevention of Frauds (Amendment) Act, No. 4 of 2024. The 2022 amendment introduced enhanced requirements concerning signatures and identification impressions in the execution of deeds and wills.
The 2024 amendment further clarified the execution requirements under section 2, requiring the executants, witnesses and licensed Notary Public to be present at the same time and in each other’s presence. It also introduced specific requirements relating to the execution of transfer deeds, including signatures and thumb impressions of both the transferor and transferee, subject to provisions concerning authorised representatives, corporate transferees and minors. These requirements serve as important safeguards against fraudulent transactions and ensure the authenticity and enforceability of instruments affecting immovable property.
Types of Deeds and Powers of Attorney
Conveyancing transactions involving immovable property are carried out through various types of deeds, depending on the nature of the transaction and the rights intended to be created, transferred, varied or extinguished. Common instruments include:
- Deed of Transfer – used to transfer ownership or an interest in immovable property from one party to another.
- Deed of Gift – used to transfer property by way of a gift, without monetary consideration.
- Deed of Mortgage – creates security over immovable property for the repayment of a debt or performance of an obligation.
- Deed of Lease – grants a right to possess and use immovable property for a specified period and on agreed terms.
- Deed of Partition – facilitates the division of jointly owned property among co-owners.
- Deed of Exchange – effects the exchange of interests in immovable property between parties.
- Deed of Assignment – transfers rights or interests arising under an existing instrument or transaction.
- Deed of Settlement/Declaration – may be used to establish or declare particular rights or interests in property
- Deed of Release/Discharge – releases or discharges specified rights, claims or encumbrances.
- Deed of Rectification, Revocation or Cancellation – used to correct, revoke or cancel a previous instrument where legally permissible.
The appropriate deed depends upon the nature of the transaction, the title to the property and the rights and interests of the parties. Instruments affecting immovable property are subject to the formal requirements prescribed by the Prevention of Frauds Ordinance and other applicable legislation.
Powers of Attorney
A Power of Attorney (POA) is a written authority by which one person, known as the grantor, authorises another person, known as the attorney, to represent the grantor and perform specified acts on the grantor’s behalf. POAs may be used for a particular transaction or for broader purposes, depending on the authority granted.
Where a POA is to be used for a transaction falling within section 2 of the Prevention of Frauds Ordinance, additional statutory requirements apply, including requirements relating to the identification and description of the relevant land and the identification documents of the grantor and attorney.
A POA executed in Sri Lanka is required to be executed before two witnesses and attested by a Notary Public, while a POA executed abroad must comply with the applicable statutory requirements concerning execution and attestation. Every POA, whether executed in Sri Lanka or abroad, is required to be registered with the Registrar General within the prescribed period.
The Powers of Attorney (Amendment) Act, No. 28 of 2022 introduced significant safeguards relating to execution, registration, verification and use of POAs. It also provides that, subject to statutory exceptions, a POA is generally valid for five years unless a shorter or different period is specified or it is revoked or cancelled earlier. The Powers of Attorney (Amendment) Act, No. 3 of 2024 further amended provisions relating to execution and revocation or cancellation of POAs.
Notaries Ordinance
The Notaries Ordinance No.1 of (1907) provides the principal legal framework governing the appointment, authority, duties and professional conduct of Notaries Public in Sri Lanka. It regulates the practice of notarial work and establishes safeguards relating to the preparation, execution and authentication of deeds and other legal instruments.
The Notaries (Amendment) Act, No. 31 of 2022 introduced significant amendments to the Ordinance, including changes concerning the qualifications and authorisation of of Deeds
The Notaries (Amendment) Act, No. 6 of 2024 introduced further safeguards and procedural requirements to the Notaries Ordinance (Chapter 107), with the objective of strengthening notarial practice and reducing the risk of fraudulent or irregular transactions.
Among the significant amendments are:
- Execution of deeds on multiple sheets: Where a deed or instrument is written on more than one sheet, the sheets must either be marked or signed by the relevant Registrar of Lands, or the parties and the Notary must sign each sheet containing part of the instrument, with the pages duly numbered.
- Stamping requirements: The amendment extends the relevant requirements to every deed or instrument and provides for stamps or proof of payment to be affixed to the duplicate. Where stamps are affixed to the duplicate, a true copy is required to be annexed to the original presented for registration.
- Identification of parties: In specified instruments, including transfers, gifts, exchanges and wills, the Notary is required to affix passport-size photographs of the signatories to the protocol and retain copies of prescribed identification documents.
- Registered Powers of Attorney: The amendment provides for a true copy of the registered Power of Attorney to be annexed to the original, duplicate and protocol where a deed is executed under a Power of Attorney.
- Duty to ascertain and explain the true transaction: A significant new provision, section 38A, requires a Notary to endeavour to ascertain the true legal nature of the transaction and expressly explain that true nature to the executants before they sign the deed or instrument. A Notary must not attest a deed of transfer where the transaction is in fact a mortgage, conditional transfer or similar transaction. Knowingly and wilfully contravening these requirements may constitute an offence punishable by a fine of up to Rs. 500,000.
The 2024 amendment therefore places greater emphasis on transparency, identification of parties, proper execution, accurate documentation and the Notary’s responsibility to ensure that the instrument reflects the true nature of the transaction.

වංචා වැළැක්වීමේ ආඥා පනත
ශ්රී ලංකාව තුළ ස්ථාවර දේපළවලට (immovable property) බලපාන ගනුදෙනු සඳහා වන විධිවිධාන නියාමනය කරන ප්රධාන ප්රඥප්තිය වනුයේ 1840 අංක 7 දරන වංචා වැළැක්වීමේ ආඥා පනත වේ. විකුණුම්, මිලදී ගැනීම්, පැවරීම්, පැවරී දීම්, උකස් සහ ස්ථාවර දේපළ මත අයිතිවාසිකම් හෝ බැදීම් නිර්මාණය කිරීම අරමුණු කරගත් ගිවිසුම් වැනි නිශ්චිත ගනුදෙනු, නීත්යානුකූල බලයක් ලබා ගැනීමට පෙර නියමිත විධිවිධානවලට අනුකූල විය යුතු බව එයින් විධාන කරයි. කැමැත්ත මත පදනම් වූ බදු දීම හෝ මාසයක් නොඉක්මවන කාලයක් සඳහා වන බදු දීම වැනි යම් බදු දීම් මෙම අවශ්යතාවලින් බැහැර කර ඇත.
අදාළ ඔප්පුව හෝ ලේඛනය ලිඛිතව තිබිය යුතු බවත්, එය සම්පාදකයන් විසින් නිසි ලෙස අත්සන් කර, අවශ්ය සාක්ෂිකරුවන්ගේ ඉදිරියේ බලයලත් නොතාරිස් මහතෙකු විසින් සහතික කළ යුතු බවත් මෙම ආඥා පනත නියම කර ඇත. එමෙන්ම, දීමනාකරුවන්ගේ නියමිත මාපටැඟිලි, අතෙහි හෝ කකුළෙහි ඇඟිලි සලකුණු අදාළ ලේඛනවල තැබීම සඳහා ද එය විධිවිධාන සපයයි. අන්තිම කැමැති පත්ර සහ කෝඩිසයිල් (අන්තිම කැමැති පත්රවලට කරන අතිරේක එකතු කිරීම්) ක්රියාත්මක කිරීමේදී ද මෙවැනි ආරක්ෂක විධිවිධාන අදාළ වේ.
මෙම ආඥා පනත, 2022 අංක 30 දරන වංචා වැළැක්වීමේ (සංශෝධන) පනත සහ 2024 අංක 4 දරන වංචා වැළැක්වීමේ (සංශෝධන) පනත මඟින් තවදුරටත් ශක්තිමත් කර ඇත. 2022 සංශෝධනය මඟින් ඔප්පු සහ අන්තිම කැමැති පත්ර ක්රියාත්මක කිරීමේදී අත්සන් සහ අනන්යතා සලකුණු සම්බන්ධයෙන් වැඩිදියුණු කරන ලද අවශ්යතා හඳුන්වා දෙන ලදී.
2024 සංශෝධනය මඟින් 2 වැනි වගන්තිය යටතේ ඇති ක්රියාත්මක කිරීමේ අවශ්යතා තවදුරටත් පැහැදිලි කරන ලද අතර, දීමනාකරුවන්, සාක්ෂිකරුවන් සහ බලයලත් නොතාරිස්වරයා එකම අවස්ථාවක සහ එකිනෙකාගේ ඉදිරියේ පෙනී සිටිය යුතු බවට නියම කර ඇත. බලයලත් නියෝජිතයන්, ආයතනික ගැනුම්කරුවන් සහ බාලවයස්කරුවන් සම්බන්ධ විධිවිධානවලට යටත්ව, පවරා දෙන්නාගේ (transferor) සහ පවරා ගන්නාගේ (transferee) අත්සන් සහ මාපටැඟිලි සලකුණු ඇතුළුව, අයිතිය පැවරීමේ ඔප්පු (Deed of Transfer) ක්රියාත්මක කිරීම සම්බන්ධ නිශ්චිත අවශ්යතා ද එය හඳුන්වා දෙන ලදී.
මෙම අවශ්යතා මඟින් වංචනික ගනුදෙනුවලට එරෙහිව වැදගත් ආරක්ෂක විධිවිධාන සපයන අතර, ස්ථාවර දේපළවලට බලපාන ලේඛනවල සත්යතාව සහ බලාත්මක වීමේ හැකියාව තහවුරු කරයි.
ඔප්පු වර්ග සහ ඇටෝනි බලපත්ර
ස්ථාවර දේපළ සම්බන්ධ අයිතිය මාරු කිරීමේ ගනුදෙනු, ගනුදෙනුවේ ස්වභාවය සහ නිර්මාණය කිරීමට, පැවරීමට, වෙනස් කිරීමට හෝ අහෝසි කිරීමට අදහස් කරන අයිතිවාසිකම් මත පදනම්ව, විවිධ ඔප්පු වර්ග හරහා සිදු කරනු ලැබේ. පොදු ලේඛන අතරට පහත ඒවා ඇතුළත් වේ:
- සින්නක්කර ඔප්පු (Deed of Transfer) – ස්ථාවර දේපළක අයිතිය හෝ අයිතිවාසිකමක් එක් පාර්ශ්වයක සිට තවත් පාර්ශ්වයකට පැවරීමට භාවිතා කරයි.
- තෑගි ඔප්පු (Deed of Gift) – මුදල් ප්රතිලාභයකින් තොරව, ත්යාගයක් ලෙස දේපළක් පැවරීමට භාවිතා කරයි.
- උකස් ඔප්පු (Deed of Mortgage) – ණය මුදලක් ආපසු ගෙවීම සඳහා හෝ බැඳීමක් ඉටු කිරීම සඳහා ස්ථාවර දේපළ මත ඇපයක් (ආරක්ෂාවක්) නිර්මාණය කරයි.
- බදු ඔප්පු (Deed of Lease) – නිශ්චිත කාලයක් සඳහා සහ එකඟ වූ නියමයන් යටතේ ස්ථාවර දේපළක් සන්තකයේ තබා ගැනීමට සහ භාවිතා කිරීමට අයිතිය ලබා දෙයි.
- බෙදුම් ඔප්පු (Deed of Partition) – හවුලේ හිමි දේපළක් සම-හිමිකරුවන් අතර බෙදා වෙන් කිරීම පහසු කරයි.
- මාරු හුවමාරු ඔප්පු (Deed of Exchange) – පාර්ශ්වයන් අතර ස්ථාවර දේපළවල අයිතිවාසිකම් හුවමාරු කර ගැනීම සිදු කරයි.
- පැවරී දීමේ ඔප්පු (Deed of Assignment) – පවතින ලේඛන යටතේ හෝ ගනුදෙනුවක් යටතේ උද්ගත වන අයිතිවාසිකම් හෝ අයිතිවාසිකම් පවරා දෙයි.
- ප්රකාශන ඔප්පු (Deed of Settlement/Declaration) – දේපළක විශේෂිත අයිතිවාසිකම් හෝ හිමිකම් ස්ථාපිත කිරීමට හෝ ප්රකාශ කිරීමට භාවිතා කළ හැකිය.
- නිදහස් කිරීමේ/මුදා හැරීමේ ඔප්පු (Deed of Release/Discharge) – නිශ්චිත අයිතිවාසිකම්, හිමිකම් හෝ බැදීම් නිදහස් කරයි හෝ මුදා හරී.
- වරද නිවැරදි කිරීමේ හෝ අවලංගු කිරීමේ ඔප්පු (Deed of Rectification, Revocation or Cancellation) – නීත්යානුකූලව අවසර දී ඇති තැන පෙර ලේඛනයක් නිවැරදි කිරීමට, අවලංගු කිරීමට හෝ අහෝසි කිරීමට භාවිතා කරයි.
සුදුසු ඔප්පුව රඳා පවතින්නේ ගනුදෙනුවේ ස්වභාවය, දේපළේ භුක්තිය (title) සහ පාර්ශ්වයන්ගේ අයිතිවාසිකම් මතය. ස්ථාවර දේපළවලට බලපාන ලේඛන, වංචා වැළැක්වීමේ ආඥා පනත සහ අනෙකුත් අදාළ නීති මඟින් නියම කර ඇති විධිවිධානවලට යටත් වේ.
ඇටෝනි බලපත්ර (Powers of Attorney)
ඇටෝනි බලපත්රයක් යනු, ඇටෝනි දීමනාකරු ලෙස න්වෙන තැනැත්තකු විසින්, ඇටෝනි බලකරු ලෙස හැඳින්වෙන වෙනත් තැනැත්තකුට, දීමනාකරු නියෝජනය කිරීමට සහ දීමනාකරු වෙනුවෙන් නිශ්චිත ක්රියා සිදු කිරීමට බලය පවරනු ලබන ලිඛිත අධිකාරියකි. ප්රදානය කරන ලද බලය මත පදනම්ව, විශේෂිත ගනුදෙනුවක් සඳහා හෝ පුළුල් අරමුණු සඳහා ඇටෝනි බලපත්ර භාවිතා කළ හැකිය.
වංචා වැළැක්වීමේ ආඥා පනතේ 2 වැනි වගන්තියට යටත් වන ගනුදෙනුවක් සඳහා ඇටෝනි බලපත්රයක් භාවිතා කිරීමට නියමිත නම්, අදාළ ඉඩම හඳුනා ගැනීම සහ විස්තර කිරීම මෙන්ම දීමනාකරු සහ ඇටෝනි බලයලත් තැනැත්තාගේ අනන්යතා ලේඛනවලට අදාළ අතිරේක ව්යවස්ථාපිත අවශ්යතා අදාළ වේ.
ශ්රී ලංකාව තුළදී ඇටෝනි බලපත්රයක් සාක්ෂිකරුවන් දෙදෙනෙකු ඉදිරියේ අත්සන් කර නොතාරිස්වරයෙකු විසින් සහතික කළ යුතු අතර, විදේශයන්හි ඇටෝනි බලපත්රයක් සහතික කිරීම සම්බන්ධ අදාළ ව්යවස්ථාපිත අවශ්යතාවලට අනුකූල විය යුතුය. ශ්රී ලංකාවේදී හෝ විදේශයකදී අත්සන් කළදද, සෑම ඇටෝනි බලපත්රයක්ම නියමිත කාල සීමාව තුළ රෙජිස්ට්රාර් ජෙනරාල්වරයා වෙත ලියාපදිංචි කළ යුතුය.
2022 අංක 28 දරන ඇටෝනි බලපත්ර (සංශෝධන) පනත මඟින් ඇටෝනි බලපත්ර ක්රියාත්මක කිරීම, ලියාපදිංචි කිරීම, සත්යාපනය කිරීම සහ භාවිතය සම්බන්ධ වැදගත් ආරක්ෂක විධිවිධාන හඳුන්වා දෙන ලදී. ව්යවස්ථාපිත ව්යතිරේකයන්ට යටත්ව, කෙටි හෝ වෙනස් කාල සීමාවක් විශේෂයෙන් සඳහන් කර ඇත්නම් හෝ එය කලින් අවලංගු කර හෝ අහෝසි කර ඇත්නම් මිස, ඇටෝනි බලපත්රයක් සාමාන්යයෙන් වසර පහක කාලයක් සඳහා වලංගු වන බව ද එයින් සඳහන් වේ. 2024 අංක 3 දරන ඇටෝනි බලපත්ර (සංශෝධන) පනත මඟින් ඇටෝනි බලපත්ර ක්රියාත්මක කිරීම සහ අවලංගු කිරීම හෝ අහෝසි කිරීම සම්බන්ධ විධිවිධාන තවදුරටත් සංශෝධනය කරන ලදී.
නොතාරිස්වරුන් පිළිබඳ ආඥා පනත
1907 අංක 1 දරන නොතාරිස්වරුන් පිළිබඳ ආඥා පනත මඟින් ශ්රී ලංකාවේ නොතාරිස්වරුන්ගේ පත්වීම, අධිකාරිය, වගකීම් සහ වෘත්තීය හැසිරීම පාලනය කරන ප්රධාන නීතිමය රාමුව සපයයි. එය නොතාරිස් වෘත්තීය කටයුතු නියාමනය කරන අතර, ඔප්පු සහ අනෙකුත් නීතිමය ලේඛන සකස් කිරීම, ක්රියාත්මක කිරීම සහ සත්යාපනය කිරීම සම්බන්ධ ආරක්ෂක විධිවිධාන ස්ථාපිත කරයි.
2022 අංක 31 දරන නොතාරිස් (සංශෝධන) පනත මඟින්, නොතාරිස්වරුන්ගේ සුදුසුකම් සහ බලය පැවරීම සම්බන්ධ වෙනස්කම් ඇතුළුව, ආඥා පනතට වැදගත් සංශෝධන හඳුන්වා දෙන ලදී.
2024 අංක 6 දරන නොතාරිස් (සංශෝධන) පනත මඟින් නොතාරිස් වෘත්තීය කටයුතු ශක්තිමත් කිරීමේ සහ වංචනික හෝ අක්රමවත් ගනුදෙනු අවම කිරීමේ අරමුණින් නොතාරිස්වරුන් පිළිබඳ ආඥා පනතට (107 වන අධිකාරිය) තවදුරටත් ආරක්ෂක විධිවිධාන සහ ක්රියා පටිපාටි අවශ්යතා හඳුන්වා දෙන ලදී.
වැදගත් සංශෝධන අතරට පහත ඒවා ඇතුළත් වේ:
- පත්ර කිහිපයක් මත ඔප්පු සකස් කිරීම: ඔප්පුවක් හෝ ලේඛනයක් පත්ර එකකට වඩා වැඩි ගණනක ලියා ඇත්නම්, එම සෑම පත්රයක්ම අදාළ ඉඩම් රෙජිස්ට්රාර්වරයා විසින් සලකුණු කර හෝ අත්සන් කළ යුතුය, නැතහොත් ලේඛනයේ කොටසක් අඩංගු එක් එක් පත්රය පාර්ශ්වයන් සහ නොතාරිස්වරයා විසින් අත්සන් කළ යුතු අතර, පිටු නිසි ලෙස අංකනය කළ යුතුය.
- මුද්දර අවශ්යතා: සංශෝධනය මඟින් අදාළ අවශ්යතා සෑම ඔප්පුවකටම හෝ ලේඛනයකටම දීර්ඝ කරන අතර, මුද්දර හෝ මුදල් ගෙවූ බවට වන සාක්ෂි දෙවන පිටපතෙහි ඇලවීමසඳහා විධිවිධාන සපයයි. දෙවන පිටපතට මුද්දර අලවා ඇති විට, ලියාපදිංචි කිරීම සඳහා ඉදිරිපත් කරන මුල් පිටපතට සත්ය පිටපතක් ඇමිණිය යුතුය.
- පාර්ශ්වයන් හඳුනා ගැනීම: පැවරීම්, ත්යාග, හුවමාරු සහ අන්තිම කැමැති පත්ර ඇතුළු නිශ්චිත ලේඛනවලදී, නොතාරිස්වරයා විසින් ප්රොටෝකෝලය වෙත අත්සන් කරන්නන්ගේ විදේශ ගමන් බලපත්ර ප්රමාණයේ ඡායාරූප ඇලවිය යුතු අතර නියමිත අනන්යතා ලේඛනවල පිටපත් රඳවා තබා ගත යුතුය.
- ලියාපදිංචි කළ ඇටෝනි බලපත්ර: ඇටෝනි බලපත්රයක් යටතේ ඔප්පුවක් අත්සන් කරනඅවස්ථාවකදී, ලියාපදිංචි කරන ලද ඇටෝනි බලපත්රයේ සත්ය පිටපතක් ඔප්පුවේ මුල් පිටපතට, දෙවන පිටතට සහ ප්රොටෝකෝලයට ඇමිණිය කළ යුතු බවට සංශෝධනය මඟින් විධාන කරයි.
- සැබෑ ගනුදෙනුව සොයා බැලීමේ සහ පැහැදිලි කිරීමේ වගකීම: වැදගත් නව ප්රතිපාදනයක් වන 38අ වගන්තිය මඟින්, ගනුදෙනුවේ සැබෑ නීතිමය ස්වභාවය කුමක්දැයි සොයා බැලීමට නොතාරිස්වරයා උත්සාහ කළ යුතු බවත්, පාර්ශ්වයන් ඔප්පුවට හෝ ලේඛනයට අත්සන් කිරීමට පෙර එම සැබෑ ස්වභාවය ඔවුන්ට පැහැදිලි කළ යුතු බවත් සදහන් කර ඇත. ගනුදෙනුව ඇත්ත වශයෙන්ම උකසක්, කොන්දේසි සහිත පැවරීමක් හෝ ඒ හා සමාන ගනුදෙනුවක් වන විට නොතාරිස්වරයා සින්නක්කර ඔප්පුවක් සහතික නොකළ යුතුය. මෙම දැනුවත්ව නියමයන් උල්ලංඝනය කිරීම රුපියල් 500,000 දක්වා දඩයකට යටත්විය හැකි වරදක් විය හැකිය.
ඒ අනුව, 2024 සංශෝධනය මඟින් විනිවිදභාවය, පාර්ශ්වයන් හඳුනා ගැනීම, නිසි පරිදි ක්රියාත්මක කිරීම, නිවැරදි ලේඛන කටයුතු සහ ගනුදෙනුවේ සැබෑ ස්වභාවය ලේඛනයෙන් පිළිබිඹු වන බව තහවුරු කිරීමේ නොතාරිස්වරයාගේ වගකීම කෙරෙහි වැඩි අවධාණයක් යොමු කරයි.
